Welcome to FastRank. These Terms of Service ("Terms") constitute a legally binding agreement between you and FastRank ("Company," "we," "us," or "our") governing your access to and use of the FastRank platform, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

FastRank is an automated SEO content generation and publishing platform. Our Service includes:

  • Automated Content Generation: AI-powered creation of SEO-optimized articles
  • Keyword Research: Automated keyword analysis and content strategy development
  • CMS Integration: Direct publishing to WordPress, Webflow, Notion, Ghost, Shopify, and other platforms via API
  • Analytics & Tracking: Performance monitoring and ranking tracking
  • Content Calendar: Automated scheduling and planning tools

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not have been previously suspended or banned from the Service
  • Comply with all applicable laws and regulations

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are solely responsible for all activities under your account, whether or not authorized by you.

4. Subscription and Payment

4.1 Pricing

FastRank offers subscription-based pricing. Current pricing is available on our website. All fees are quoted in U.S. Dollars.

4.2 Free Trial

We offer a 3-day free trial for new users. During the trial, you may generate up to 3 articles. No payment is required to start the trial.

4.3 Billing

  • Subscriptions are billed monthly in advance
  • Payment is processed through Stripe, our third-party payment processor
  • You authorize us to charge your payment method on a recurring basis
  • Failed payments may result in suspension of your account

4.4 Refunds

All fees are non-refundable except as required by law. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.

4.5 Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect.

5. License and Usage Rights

5.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your business purposes.

5.2 Generated Content Ownership

You own all content generated through the Service for your account. Once content is generated for you, you have full rights to use, modify, publish, and distribute that content as you see fit.

5.3 Restrictions

You may not:

  • Sublicense, sell, or redistribute access to the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to develop a competing product
  • Remove or alter any proprietary notices or labels
  • Use the Service in any way that violates applicable law

6. User Content and Data

6.1 Your Content

You retain ownership of any content, data, or information you provide to the Service, including:

  • Website URLs and brand information
  • Keywords and topic preferences
  • CMS credentials and API keys
  • Custom instructions and preferences

6.2 License to Use Your Content

By providing content to the Service, you grant us a limited license to use that content solely for the purpose of providing and improving the Service.

6.3 Content Accuracy

You are responsible for ensuring that any information you provide is accurate and that you have the right to use and share it.

7. Acceptable Use

7.1 Prohibited Uses

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, or infringes third-party rights
  • Create spam, misleading content, or malicious material
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt unauthorized access to any systems or networks

  • Generate content promoting violence, hate speech, or discrimination
  • Create adult content, illegal substances promotion, or fraudulent schemes

7.2 Content Compliance

You are solely responsible for ensuring that content published through the Service complies with all applicable laws, including:

  • Copyright and trademark laws
  • FTC disclosure requirements
  • Industry-specific regulations (e.g., healthcare, financial services)

8. Third-Party Integrations

8.1 CMS Platforms

The Service integrates with third-party CMS platforms. Your use of these integrations is subject to the respective platform's terms of service.

8.2 API Keys and Credentials

You are responsible for securing any API keys or credentials you provide. We are not liable for any issues arising from compromised credentials.

8.3 Third-Party Services

We use third-party services including:

  • Stripe for payment processing
  • AI providers for content generation
  • Analytics services for performance tracking

Your use of these services through FastRank is subject to their respective terms and privacy policies.

9. Service Availability

9.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency repairs
  • Factors beyond our control

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes.

10. Intellectual Property

10.1 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by FastRank and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without any obligation to you.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We specifically disclaim:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy or reliability of results
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding SEO performance, search rankings, or traffic results

SEO results vary based on many factors outside our control, including search engine algorithms, competition, and website quality. We do not guarantee any specific rankings or traffic outcomes.

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTRANK SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Any damages arising from service interruptions or data loss
  • Any damages resulting from third-party actions or content

12.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12.3 Basis of the Bargain

The limitations in this section reflect a reasonable allocation of risk and are a fundamental part of these Terms.

13. Indemnification

You agree to indemnify, defend, and hold harmless FastRank and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you publish through the Service

14. Termination

14.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings or by contacting us.

14.2 Termination by Us

We may suspend or terminate your access to the Service if:

  • You violate these Terms
  • You fail to pay applicable fees
  • Your use poses a security risk
  • We are required to do so by law

14.3 Effect of Termination

Upon termination:

  • Your right to access the Service ends immediately
  • You remain responsible for any outstanding fees
  • Provisions that by nature should survive will continue (e.g., limitation of liability, indemnification)

15. Dispute Resolution

15.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us and attempt to resolve any dispute informally for at least 30 days.

15.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in the United States, and judgment on the award may be entered in any court of competent jurisdiction.

15.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class arbitrations.

Either party may seek injunctive or equitable relief in court for intellectual property disputes.

16. General Provisions

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FastRank regarding the Service.

16.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16.4 Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

16.5 Assignment

You may not assign these Terms without our prior written consent. We may assign our rights and obligations freely.

We may provide notices to you via email, through the Service, or by posting on our website. Notices to us should be sent to the contact information below.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:
